A reentry permit is applied for by permanent residents or conditional residents who plan to stay outside the U.S. for more than one year.
Permanent residents who leave the U.S. for an extended period without demonstrating intent to reside permanently in the U.S. risk losing their permanent resident status. Therefore, if you plan to be outside the U.S. for more than 12 months, you must obtain a reentry permit before departing.
To apply, you need to submit Form I-131 (Application for a Travel Document). The USCIS processing time is approximately 2 to 3 months. The reentry permit is typically valid for 2 years and can be granted for up to a maximum of 5 years.
Even if you have obtained a reentry permit, it is important to maintain evidence that you intend to reside permanently in the U.S. Such evidence includes maintaining a U.S. bank account, owning or keeping a home or real estate in your name within the U.S.
If you stay outside the U.S. for more than one year, you must reside in the U.S. for another five years before you can apply for citizenship. During a long-term stay in Korea, you may apply to preserve your residence for naturalization purposes; however, to remain eligible for citizenship, you must be physically present in the U.S. for at least 2 years and 6 months out of the 5-year period.
